Restoration Cleaning: Our Principal Limited Liability & Disclaimer 2018-2019.
We accept credit cards, checks, Paypal, VenMo, and BitCoin. We do not normally accept checks of any kind with the exception of payments from larger accounts. Restoration Cleaning does not accept cash.
When you place an order with us, you are also accepting our disclaimer and our limited liability with respect to any lost or damaged articles manufactured from cotton or synthetic, man-made materials that shall not exceed 10 times our charge for processing that article. You are also accepting our release forms, disclaimers and limited liability for natural materials. We assume no liability whatsoever for the loss or damage, such as shrinking, fading, blemishing, wearing, tearing, discoloration or stretching of articles manufactured from natural materials - including but not limited to - wool, silk, linen, hides such as leather and suede, or any other kind of animal or plant-based fabric except for cotton.
DISCLAIMER - GARMENT CARE
By placing an order with Restoration Cleaning, you acknowledge that there is no one optimal recommend way to clean or restore natural or synthetic fabrics and that all decisions made by us are at our discretion and are final. Furthermore, while we exercise utmost care in processing articles entrusted to us and use such processes which, in our opinion, are best suited to the nature and condition of each article, the behavior of fabrics made from natural materials is unpredictable during washing, wet cleaning, dry cleaning or any other process the purpose of which is to clean or restore articles of clothing, handbags, shoes or any other article made of such materials. We cannot assume responsibility for inherent weaknesses of, or defects in, materials that are not readily apparent prior to processing. This applies particularly, but not exclusively, to natural materials such as suedes, leathers, silks, linens, wools and so on, but also includes satins, double-faced fabrics, vinyl, polyurethanes and other synthetic materials. Responsibility also is disclaimed for trimmings, buckles, beads, buttons, bells and sequins and any other decorative aspect of the article that is submitted to us.
GARMENT CARE - LABELS
We always take care of garments strictly according to the manufacturer's care label. No special requests to deploy a cleaning technique other than that specified on the original label will be entertained. If the garment care label is missing, damaged or illegible then Restoration Cleaning under no circumstances will be responsible for any damage to the garment that occurs during the cleaning process.
Replacement costs up to $100 require only proof of damage, such as physical inspection, or photographic evidence. If the replacement costs exceed $100 then our standard form must be completed and submitted with receipts or other proof of purchase such as credit card billing, in addition to the foregoing.
With wash and fold garments and other articles, we are not responsible for any items in the wash and fold order as the items are aggregated and processed by weight, not by garment count, and as such these items are not inspected. Therefore we will not be responsible for any claims, including shrinkage, discoloring, runs, dye transfer, rips, tears, or any other damage. This also includes any items claimed loss or missing. Note also that at Restoration Cleaning, as a mobile restoration remedy service, laundry and dry cleaning items are not counted at the time of pick-up, but instead they are logged in individually at our facility. Restoration Cleaning is not responsible for any item claimed lost or stolen from designated drop off or delivery areas. As such, our internal count is determined to be the accepted and final item count. Restoration Cleaning will not be held liable for any items claimed sent, missing or damaged.
We are not responsible for unclaimed items or for orders that have not been paid for. Completed orders not paid for and/or not picked up, or that are undeliverable through no fault of our own, are subject to a storage fee following completion of the order. Unless by prior arrangement any cleaned items not picked up, or that remain undeliverable, after 30 days will be donated to charity. All unclaimed articles will be handled in accordance with state regulations.
In the case of any disagreement, you agree to reach an agreement through arbitration. You agree to pay any legal fees associated with any and all disputes.
LATE PAYMENT FEES
We will work directly with your insurance company to make billing and payment as painless as possible. However if you are paying out-of-pocket we will charge an additional 10% of the amount left unpaid for each (partial) month of any remaining unpaid balance.
Failed pick-up: up to $500 for each failed attempt
After pick-up: up to $1,000 (initial pick-up fee $250, plus return fee $500, plus service fee $250)
Failed delivery: up to $500 for each failed attempt
NOTE: Restoration Cleaning takes fraud seriously. This statement takes precedence and supersedes any such previous statements made by or on behalf of Restoration Cleaning.
